The short version: you may use WireVitals for free on your own devices. Test only networks and devices you own or have permission to test. The app measures and explains as well as it can, but it can be wrong, and it comes with no warranty. Your data stays on your device — see the privacy policy.
These terms are an agreement between you and Extrosy ("we", "us") about the WireVitals app for Android ("the app"). By installing or using the app you accept them. If you do not accept them, do not install or use the app. If you got the app from Google Play, Google Play's own terms also apply to the download itself; Google is not a party to this agreement and has no responsibility for the app.
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own purposes. You may not sell, rent, sub-license or redistribute the app, remove its notices, or present it as your own. Except where the law allows it regardless of this agreement, you may not copy, modify or reverse-engineer the app. The app includes open-source components, which are licensed to you under their own licences, not this one — see the open-source notices. We keep all other rights in the app and its name. "WireVitals" and "Extrosy" are our trademarks.
WireVitals contains real network tools. You agree to use them responsibly and lawfully:
You are responsible for how you use the app and for the consequences.
WireVitals measures your connection at one moment, from one device, through servers it does not control, and then interprets what it measured. The measurements can be affected by the device, the network, the servers and the time of day, and the explanations can be wrong. Treat the results as information to help you investigate, not as professional, legal or contractual advice — for example, not as proof that a provider has broken a contract. Do not rely on the app where a mistake could put anyone's safety, health or property at risk.
To test your connection the app contacts public services run by other companies — test servers, DNS and time servers, address look-up services and the like; the privacy policy lists them. We do not control those services. They may change, limit or stop at any time, which can make a check fail or report something wrong. Their own terms and privacy policies apply to them.
The app is provided "as is" and "as available", without warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement — to the fullest extent the law allows. We do not promise that the app will be error-free, uninterrupted or compatible with every device or network.
To the fullest extent the law allows, Extrosy is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, business or goodwill, arising out of or related to your use of the app or its results, even if we were told such damages were possible. Our total liability for any claim related to the app is limited to the amount you paid for the app in the twelve months before the claim, or US$10 if you paid nothing.
Some places do not allow some of these exclusions or limits. Where that is the case, they apply only as far as that law permits, and nothing in these terms limits rights you have as a consumer that cannot be limited by agreement.
If you use the app against these terms or the law — for example, to scan a network without permission — and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
We may update the app, change or remove features, or stop offering it. This agreement lasts until it ends: you can end it at any time by uninstalling the app, and it ends automatically if you break these terms. Sections 6 to 11 continue after it ends.
If we change these terms, we will post the new version at this address with a new effective date. Continuing to use the app after that means you accept the new version.
These terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-law rules, and disputes are to be brought in the state or federal courts located in Minnesota — except where the law of the place you live gives you the right to bring a claim there. If any part of these terms cannot be enforced, the rest still applies. These terms, together with the privacy policy, are the whole agreement between you and us about the app. Not enforcing a part of them is not a waiver of it.
